Judges Gewin and Wisdom were inclined at conferect to affirm, with Judge Hutcheson in favor of reversal. Judge Gewin, upon writing the opinion, came to adopt the Hutcheson position. Judge Wisdom concurred in the Gewin opinion, the panel thus unanimously, for reversal.
