Congress of Racial Equality v. Douglas No. 19,724; 318 F.2d 95, cert. den. Burt v. Congress of Racial Equality, 375 U.S. 829 (1963) Judge Wisdom had already concurred when Chief Judge Tuttle revised his opinion. Judge Wisdom resubmitted his concurrence in the revised draft.

Judge Gewin conditioned his concurrence on acceptancy by Chief Judge Tuttle and incorporation into the opinion of a proposed memorandum he had written. Chief Judge Tuttle declined, and Judge Gewin subsequently filed a dissent.
