File — Folder: 3
Identifier: Folder 3
No. 20,618; 328 F.2d 427, cert. den. 379 U.S. 950 (1964)
Per Curiam.
In Robinson v. Celebrezze, 326 F.2d 840 (1964) Judge DeVane was to write an opinion to reverse the district court, in which Judge Wisdom would concur. Judge Cameron intended to dissent. Judge DeVane came to feel that the opinion should instead be written by Judge Wisdom, whom he accordingly asked to prepare one. Before Judge Wisdom had responded, Judge DeVane died.
Judge Cameron offered to concur in such an opinion as Judge Wisdom should draft, so not to affect the contemplated result. Judge Wisdom, however, had by this time come around to the Cameron position, and the dissent prepared by the latter became the opinion of the court.
Includes TLS of Judge DeVane, TL of Judge Cameron and TL of Judge Wisdom on the opinion to be written in Robinson.
