Fragus No. 27,801; 428 F.2d 1211 (1970) Originally screened by a panel of Judge Wisdom, Coleman and Simpson, Judge Coleman suggested the case be classified as a Class I, and circulated a proposed per curiam affirmance. Judge Wisdom objected and suggested that the case be reclassified and that supplemental briefs be filed. The case was then heard by a panel of Chief Judge Brown, Judges Coleman and Clark. Includes proposed affirmance of Judge Coleman; and, TL of Judge Wisdom on the Coleman opinion and on reclassification as appropriate. Also includes TLS of Judge Simpson and TL of Judge Wisdom on the subsequent opinion of the panel, and on reconsideration of the opinion by the panel as appropriate.
