Dissenting opinion on denial of rehearing of Judge Wisdom. While Judge Wisdom authored the initial per curiam affirmance in this case, on petition for rehearing he came instead to favor reversal, and dissented from the failure of the court to grant rehearing en banc and so hold. Chief Judge Brown and Judges Ainsworth and Dyer joined in the dissent, although they each had voted against the rehearing.
