No. 75-1008; 538 F.2d 652 (1976), mod. 544 F.2d 1258, cert. den. 434 U.S. 822 (1977) Opinion of Judge Wisdom specially concurring on petition for rehearing. On petition for rehearing en banc, Judges Goldberg and Clark expressed concern over the panel's opinion, and Chief Judge Brown intended to poll the court on the need for en banc reconsideration. Judge Ingraham proposed in response the order to modify the original opinion, and the poll was averted. Includes TLS of Judge Goldberg and TLS of Judge Clark on the opinion of the panel. Also includes TLS (and draft TL bearing holograph revisions) of Judge Wisdom on the merits, the revised Ingraham majority opinion, and his proposed special concurrence.
