Judge Whitaker circulated a proposed opinion to affirm, and twice then revised it to accord more nearly with Judge Thornberry's views. Judge Wisdom circulated an opinion to reverse, in which Judge Thornberry concurred, instead.

Judge Whitaker died, without having taking any further action on the proposed opinions. This case was decided by a quorum.
