Judge Coleman requested an en banc poll here, in light of participation in desegregation cases by district judges and judges from outside the circuit sitting by designation, and because of what he felt to be disproportionate past assignment of circuit judges to panels hearing such appeals. Judge Brown accordingly circulated the administrative forms, polling on these, and at the same time on other, similar cases. Judge Coleman protested, suggesting that to include the additional caes in the poll was to defeat the request. Includes TLS of Judge Coleman on rehearing en banc as appropriate, and on assignments to panels in cases involving desegregation, generally; TLS (3) of Chief Judge Brown on the Coleman request and the ensuing poll; and, TLS of Judge Coleman on the positions of Chief Judge Brown and Judge Wisdom, and on the en banc request.
