No. 72-1582; 494 F.2d 1050 (D.C.Cir. 1974) While the judges originally were agreed to affirm, Judge Fahy reconsidered in favor of reversal and circulated an opinion to that effect. This opinion, as subsequently revised, became his separate opinion concurring in part and dissenting in part when Judges Wilkey and Wisdom did not agree with him.
