Disposition of this appeal was delayed as the court thought that the issues would be resolved in United States v. Clark, 249 F. Supp. 720 (S.D. Ala. 1965), then pending. When decided, however, Clark was not dispositive.

Judge Bell responded to Judge Wisdom's original prosposed opinion by circulating an opinion concurring in part and dissenting in part. Judge Wisdom as a result revised his proposed opinion, and Judge Bell then revised his opinion to a special concurrence.
