Judge Wisdom and Judge Burger did not agree with the opinion first proposed by Judge Hutcheson, and it was decided that Judge Wisdom would write for the majority -- Judge Hutcheson to dissent. Judge Hutcheson then suggested that his original proposal be modified so to serve as the opinion of the court. Judges Burger and Wisdom agreed. Judge Wisdom concurred: the opinion was once more revised to accomodate Judge Burger.
