No. 28,522; 434 F.2d 1219 (1970), cert. den. United States Steelworkers of America v. Aubumdale Freezer Corp., 402 U.S. 1013 (1971) Dissenting opinion of Judge Wisdom. In conference the Judges agreed to grant the petition for review and set aside the board's order. Judge Wisdom was assigned the opinion. On researching the opinion, Judge Wisdom came to feel that the petition should instead be denied, and circulated an opinion to that effect. Judges Jones and Coleman chose to adhere to the original conference view, and Judge Wisdom's proposed opinion was fashioned into a dissent.
