No. 73-2256; 503 F.2d 940 (1974) Judges Wisdom and Goldberg tended at conference toward reversal, on authority of Gagnon v. Scarpelli, 411 U.S. 778 (1973). Judge Lynne was to dissent. The Wisdom opinion, however, would hold on other grounds with Judge Lynne to file a special concurrence. Includes memorandum of Judge Gee on the merits.
