No. 30,847; 445 F.2d 607 (1971) Judge Wisdom circulated a per curiam opinion to affirm the judgment to below, in which Judge Coleman concurred. Judge Simpson disagreed both with the classification of the case as one not in need of oral argument and with the proposed holding on the merits of Judge Wisdom. The opinion accordingly was not released; the case was set for oral argument.
