While in conference the judges were tentatively agreed to affirm, Judge Wisdom circulated instead a proposed opinion to reverse and remand. Judge Morgan concurred. Judge Rives circulated a proposed dissent, prompting Judge Wisdom to revise his proposal, and to base the holding on different grounds. Judge Rives in turn revised his dissent.
