No. 74-2444; 557 F.2d 1126, reh. den. 564 F.2d 97 (1977), cert. den. Oil, Chemical & Atomic Workers International Union v. Johns-Manville Products Corp., 436 U.S. 956 (1978) Dissenting opinion of Judge Wisdom. In conference Judges Wisdom and Fay were inclined to enforce the order of the Board and Judge Gee inclined to deny its enforcement. Judge Fay, however, came to support the position of Judge Gee, and circulated an opinion so holding. Judge Gee concurred, leaving Judge Wisdom to dissent. Includes TLS (2) of Judge Fay, TLS (2; and drafts) of Judge Wisdom, and TLS of Judge Gee on the judges positions at conference, the merits, and the proposed Fay opinion. Also includes TLS of Mike Sundermeyer, former law clerk to Judge Wisdom, then law clerk to Justice Harry A.
