Danner v. Phillips Petroleum Co. No. 30,267; 447 F.2d 159, reh. den. 450 F.2d 881 (1971) Chief Judge Brown expressed his disapproval of the panel opinion prior to publication. Judge Tuttle, a member of the panel, came to agree with him. He circulated a dissenting opinion, which would later be filed as a dissent from the denial of the petition for rehearing, and in which Judge Wisdom would concur.
