The change was made by Judge Wisdom and the Simpson opinion was withheld. Includes proposed special concurrence/TLS of Judge Simpson on revision of the Wisdom opinion as appropriate, and on the opinion of Judge Coleman in Williams v. Beto, 354 F.2d 698 (1965) and his own opinion in Pennington v. Beta, 437 F.2d 1281 (1971).
