Intended as a per curiam, the opinion in this case was signed by Judge Wisdom as requested by Judge Brown.

Judge Brown had concurred in the proposed opinion of Judge Wisdom when the opinion was revised, and Judges Brown and Hutcheson had concurred when the opinion was yet again revised.

After the concurrences of Judge Hutcheson and Brown had been obtained, Judge Jones challenged the jurisdiction of the deciding panel, believing the matter instead to have been before a panel of Judges Jones, Wisdom, and Bell.

Includes draft opinions bearing holograph concurrences of Judges Hutcheson and Brown: TL of Judge Wisdom on the merits, the panel to decide the appeal, and his opinion as first proposed; ANS of Judge Brown on the Wisdom opinion as first proposed and on certain revisions as appropriate; ANS of Judge Brown on the opinion as revised and the Hutcheson concurrence; and, TL of Judge Wisdom on final revision of his opinion.
