While preparing the opinion, however, Judge Wisdom came to think that argument was needed. He circulated the draft opinion and polled the other judges of the panel on the matter. Judge Simpson did not think argument necessary, and suggested affirmance on the basis of the District Court opinion. Judge Coleman was indifferent, and Judge Wisdom proceeded to prepare the opinion.
