Groner No. 71-1091; 479 F.2d 577 (1973), rev'g 475 F.2d 550 (1972), vac'd 414 U.S. 969 (1973)/ on remand 494 F.2d 499, cert. den. 419 U.S. 1010 (1974) Judge Thornberry circulated a per curiam opinion to affirm the panel opinion, in accord with the conference decision of a majority of the judges. Judges Gewin, Bell and Dyer circulated a proposed dissent, jointly authored, and Judge Ainsworth circulated a separate dissenting opinion. Judge Thornberry proposed to respond in a full length opinion, which would become a dissent when Judge Clark changed his vote, to concur specially in the Gewin opinion. Includes supplemental brief of appellant.
