Huff v. N.D. Cass Co. of Alabama No. 71-2842; 485 F.2d 710 (1973), aff'g in part 468 F.2d 172 (1972) This case had been put en banc before the opinion of the Supreme Court in Moose Lodge v. Irvis, 407 U.S. 163 (1972) was released. In light of Moose Lodge, Judge Coleman requested reconsideration of the vote to decide the case en banc. Huff was argued before and decided by the court en banc, Moose Lodge and the Coleman request notwithstanding.
