United States v. Soriano No. 72-1520; 497 F.2d 147 (1974), aff'g in part, rev'g in part 482 F.2d 469 (1973) Unable to attain a majority in his opinion originally proposed for the en banc court, Judge Gee substituted a revised draft, in which a majority did concur. Judge Dyer, who had intended to file an opinion concurring specially, instead withdrew his opinion and concurred in the Gee redraft. Includes holograph notes of Judge Wisdom on oral argument; and, holograph notes of Judge Wisdom and TLS of Judge Godbold on the en banc conference positions of the judges. Also includes original proposed opinion of Judge Gee. And includes proposed opinion of Judge Dyer; TLS of Judge Dyer on his proposed opinion as opposed to his stated position at conference; and, TLS of Judge Thornberry on the proposed Dyer opinion. And includes TLS of Judge Gee on revision of the majority opinion in view of the Dyer dissent. And includes TLS of Judge Gee on the merits and his opinions in Soriano and in United States v.
