United States v. Soriano No. 72-1520; 497 F.2d 147 (1974), aff'g in part, rev'g in part 482 F.2d 469 (1973) Unable to attain a majority in his opinion originally proposed for the en banc court, Judge Gee substituted a revised draft, in which a majority did concur. Judge Dyer, who had intended to file an opinion concurring specially, instead withdrew his opinion and concurred in the Gee redraft. Includes holograph notes of Judge Wisdom on oral argument; and, holograph notes of Judge Wisdom and TLS of Judge Godbold on the en banc conference positions of the judges. Also includes original proposed opinion of Judge Gee.
