Reine v. Town of Sorrento Democratic Executive Committee C.A.No. 73-120. Judge West circulated a memorandum on the merits and Judge Rubin disagreed with its recommendations. Judge West at first took no further action, then indicated his agreement in part with Judge Rubin. Judge Rubin ultimately proposed, first to Judge Wisdom, then to the full court, a per curiam opinion of his own.
