Fortune v. Molpus

No. 29,659; 431 F.2d 799 (1970) After Judge Wisdom circulated his proposed order Judge Clark submitted a concurring opinion. Judge Wisdom revised his opinion accordingly, and proposed that the opinions be filed. In an effort to reach a unanimous result, Judge Clark then indicated revisions which would be necessary for him to find the Wisdom draft acceptable. With one exception these were adopted; Judge Clark withdrew his separate opinion and concurred in that of Judge Wisdom.
