Kohler v. Tugwell C.A.No. 68-253; 292 F.Supp. 978 (E.D.La. 1968), aff'd 393 U.S. 531 (1969) Concurring opinion of Judge Wisdom. Judge Wisdom circulated a concurring opinion in response to the proposed opinion of Judge Rubin. Judge Rubin then circulated two different revisions of his opinion, from which the other judges were to choose. Judge Wisdom's opinion was revised; Judge Rubin's was revised as well. Includes TL of Judge Rubin on the merits, on plaintiff's motion for assignment to a three-judge court, and referring to Miller v. Smith, 236 F.Supp. 927 (E.D.Pa. 1965); and, TLS of Judge Brown on the motion for a three-judge court, and on Miller. Also includes original proposed opinion of Judge Rubin; TLS of Judge Rubin and TL of Judge Wisdom on the Rubin opinion; and, draft concurring opinion (bearing holograph notes) of Judge Wisdom. And includes proposed alternate revisions of Judge Rubin; TLS of Judge Rubin on the Wisdom concurrence and the original and revised Rubin opinions; and, ALS of Judge Rubin on the final opinion.
