Judges Wisdom and Brown were tentatively agreed to reverse, and Judge Rives was for affirmance. Judge Wisdom circulated opinions both to reverse and to affirm. Judge Brown favored the former, Judge Rives, however, prevailed, and at his suggestion the reported opinion to affirm incorporates much of the proposed opinion to reverse.
