Of three points raised on appeal, Judge Wisdom and Chief Judge Hutcheson tentatively agreed to reverse on one, Judge Wisdom to write the majority opinion, Judge Tuttle to dissent. Judge Wisdom reconsidered; Chief Judge Hutcheson suggested that he, rather than Judge Wisdom, should write the opinion. Judge Wisdom then circulated a draft to reverse on two of the three issues, and Chief Judge Hutcheson responded by dissenting in part. As the opinion is reported, Judge Wisdom wrote for a majority of the court on two issues, Chief Judge Hutcheson on the third.
