The judges had apparently agreed at conference to reverse although there was later disagreement among them concerning what their original positions had been. Judge Wisdom circulated an opinion for affirmance; Judge Brown concurred. Judge Jones considered a dissent; Judge Brown reconsidered. Judge Wisdom then revised the opinion in order to reverse, in accordance with the views then held by the other judges.
