While the judges had tentatively agreed to affirm, Judge Rives came to feel that the case could not properly be so decided, and submitted to Judges Brown and Wisdom, who concurred, a proposed opinion to reverse. Finally, after calling for supplemental briefs, Judge Rives settled once again on reversal. Judges Brown and Wisdom concurred in his third opinion, the second to that effect.
