Judges Wisdom and Rives had tentatively decided to reverse, and Chief Judge Hutcheson intended to dissent. Chief Judge Hutcheson returned Judge Wisdom's proposed opinion for reversal with extensive charges and suggestions, intimating that an en banc rehearing would be called. Judges Wisdom and Rives decided to affirm.
