Chief Judge Hutcheson was originally for affirmance but subsequently decided in favor of reversal. Judges Rives and Tuttle were in favor of reversal on other grounds. Chief Judge Hutcheson circulated an opinion to be filed either as a special concurrence or a dissent, but withdrew it when Judge Wisdom's opinion disposed of the case as he had urged.
