Judge Cameron proposed an opinion to remand for a new trial. Judge Tuttle initially favored affirmance instead, then came to agree that the judgment should be reversed. He suggested, however, that the court render judgment rather than remand. Judge Wisdom agreed; the opinion was revised accordingly.
