Judge Brown was of the view that the case should have been remanded in lieu of rendition, but nonetheless concurred in the majority opinion.
The opinion as proposed by Judge Rives was first revised to meet objections of Judge Brown, and, references in the opinion to the proceedings below as conducted by Judge Bootle were then 'toned down' at the suggestion of Judge Wisdom.
