In Barnett, (316 F.2d) Chief Judge Tuttle proposed an Order on Motions argued February 8, which was revised at the suggestion of Judge Rives.

Judge Rives undertook to express the views of Chief Judge Tuttle and Judges Brown and Wisdom in an opinion he submitted to them (330 F.2d). After conferring with Chief Judge Tuttle and Judge Brown , this opinion was revised and sent to the remaining judges. It would be further revised at the suggestion of Judge Brown. The addendum was authored by Judge Brown, revised at the suggestion of Judge Rives, revised again at the suggestion of Judge Wisdom, and retitled in view of Judge Jones; objections to its original title.

Judge Brown drafted a per curiam Certificate Statement of Facts, which he circulated to Chief Judge Tuttle and Judges Rives and Wisdom. Chief Judge Tuttle and Judge Bell would later revise the Brown proposeal, upon receipt of the individual opinions. Judge Rives and then Judges Brown and Cameron objected in part to the Tuttle/Bell revision and it was, accordingly, revised. Judge Jones rewrote the certified question.

Judge Bell revised his opinion just prior to publication, as did Judge Gewin his. The Statement was amended at the suggestion of Judge Cameron. Judge Rives suggested one final change in the Tuttle/Rives/Brown/Wisdom opinion, which was not adopted.
