In United States v. Barnett, 346 F.2d 99 (1965), Judge Bell, appointed pre-trial judge on remand from the Supreme Court, circulated a letter on the issues to be resolved. Following responses from Chief Judge Tuttle and Judges Jones and Brown, Judge Rives responded and suggested that the entire proceedings be dismissed. After Judge Gewin agreed, Chief Judge Tuttle called a conference.
Judge Rives proposed an Order to be entered, which was revised pursuant to suggestions of Judges Jones and Bell. Chief Judge Tuttle indicated that he would concur in the Rives Order in the interest of unanimity, but that he would join a dissenting judge if the court divided. He suggested further revision in the Rives proposal, which was done notwithstanding that he did not, ultimately, join it. A footnote was omitted at Judge Jones' request.
Judge Wisdom disclosed that he intended to file a dissent. Chief Judge Tuttle and Judge Brown then indicated likewise, preferring however to awawit Judge Wisdom's opinion before drafting their own.
