He proposed instead an opinion to reverse and remand. Chief Judge Tuttle disagreed and the opinion of Judge Rives was revisesd. Chief Judge Tuttle still would not concur, and Judge Wisdom cast the deciding vote. Judge Rives' proposed opinion became a dissent; Chief Judge Tuttle writing for the majority. On petition for rehearing, Chief Judge Tuttle circulated a per curiam opinion to deny. Judge Brown objected, believing it to conflict with Travelers Insurance v. Busy Electric Co., 294 F.2d 139 (1961), decided by a panel of Judges Cameron, Brown and Wisdom. The opinion was revised so to meet the objection of Judge Brown. Includes proposed opinion of Judge Rives; TLS (3) of Judge Rives and TLS (2) of Judge Tuttle on the merits and the Rives opinion; revised opinion of Judge Rives; TLS of Judge Rives, TLS of Chief Judge Tuttle and TL of Judge Wisdom on the revised Rives opinion and the merits; and, TLS of Judge Rives on his dissent. Also includes proposed per curiam denial of rehearing; TLS (2) of Chief Judge Tuttle, TLS (2) of Judge Brown and TLS of Judge Rives on the opinion on petition for rehearing and on the meritts; and, TL of Judge Wisdom on the revised opinion on rehearing and on certain changes in the opinion as appropriate.
