At conference Judge Wisdom was assigned the opinion, and he circulated a draft dissenting opinion. Judge Bottle sided with Judge Rives. Both drafts were revised: Judge Rives; proposed dissent to become the majority opinion to reverse, Judge Wisdom's draft affirmance into a dissent.
