Scope and Contents Case No. 90-3051 While the facts detailed in the pleadings suggest that Westowne may have violated the terms of its lease with Solo Serve, we must AFFIRM the grant of summary judgment in favor of Westowne because of the complete failure of Solo Serve to ensure that sufficient evidence was presented at the time of Westowne's summary judgement motion to create a genuine issue of material fact.
