Scope and Contents Turner v. United States No. 25,526; 415 F.2d 1234 (1969), on reh'g 441 F.2d 736 (1971) Judge Bell questioned the proposed panel opinion to reverse in this case. When, however, on petition for rehearing the panel decided to affirm and adopted the dissenting opinion of Judge Thornberry, the anticipated en banc request was not made.
