Scope and Contents No. 28,217; 437 F.2d 34 (1971) Dissenting opinion of Judge Wisdom. Judge Wisdom disagreed with the majority of Judges Ingraham and Brewster and requested that the court be polled as to a possible en banc rehearing. This was approved. The panel then reconsidered its opinion and decided to reverse and remand, thus avoiding the en banc rehearing.
