Opinion of Chief Judge Brown.
Chief Judge Brown circulated a proposed opinion to vacate and remand to the district court. Judges Wisdom and Ainsworth disagreed and requested him to reconsider. He then rewrote the opinion to affirm, and prepared an opinion in which he concurred specially.
Judge Wisdom circulated a concurring opinion, which was incorporated by Chief Judge Brown into the opinion of the court.
Includes original opinion of Chief Judge Brown; TLS of Chief Judge Brown and TL of Judge Wisdom on the merits and the proposed Brown opinion; and, TLS of Chief Judge Brown and TLS of Judge Wisdom on the revised opinion and special concurrence of the former.
Also includes proposed concurring opinion of Judge Wisdom; and, TLS of Chief Judge Brown on the revised majority opinion and the incorporation of the Wisdom concurrence.
