Judge Wisdom circulated a letter in defense of his opinion for the panel and voted to deny the petition for rehearing. He then changed his vote to favor rehearing, suggesting an order to be entered which contemplated reconsideration on briefs. Judges Coleman, Godbold and Gewin pressed for oral argument, a majority of the court so voting when a motion for oral argument of rehearing was filed. Includes TLS of Judge Godbold, TLS of Judge Bell, TLS (2) of Judge Wisdom and TLS of Chief Judge Tuttle on the panel opinion and the petition for rehearing; TLS (2) of Judge Coleman, TLS (2) of Judge Godbold and TLS (2) of Judge Gewin on the need for oral argument; and, TL of Judge Wisdom to Chief Judge Frank M. Johnson (M.D.Ala.) on the opinion. Also includes TLS (2) of Judge Sobeloff referring to his opinion in Cypress v. Newport News General and Nonsectarian Hospital Association, Inc., 375 F.2d 648 (4th Cir. 1967) and otherwise on disposition of that case.
