Chief Judge Tuttle submitted to the other judges a draft preliminay injunction and a proposed Order and Judgment on Civil Contempt. The Injunction was entered shortly thereafter (328 F.2d). As to the Order on contempt, Judge Wisdom indicated his concurrence. Judges Rives and Brown jointly disagree, and suggested that it not be filed immediately. Judge Brown then submitted his own proposal, while Judges Jones and Gewin each submitted dissents. The Order was withheld and the judges met in conference.
Chief Judge Tuttle then submitted a second Order, in which Judge Rives and Judge Wisdom concurred. Judge Gewin again circulated a dissent, as did Judge Jones. The Jones dissent prompted Judge Rives to reconsider,withdraw his concurrence, and draft his own dissent. Judge Bell then submitted an opinion concurring specially. Judge Wisdom began to draft an opinion, which was not completed. Final action was again deferred, in view of prevailing international tensions.
